However, what is apparent, is that Livia Giuggiola's use of harassment legislation is entirely inappropriate, given the affair that she has only now revealed, and the inevitable untidy, emotional process of disentanglement that would naturally be involved.
Deceit, adultery and betrayal will inevitably stir intense feelings that, in a civilised society, should be expressed in words and through communications. Such democratic freedom of expression has absolutely no place in the court room. Those who embark on such high risk escapades cannot be surprised, when the liaison ends, that emotions run high, information is shared and facts are revealed. Courts should not be the places that conceal artifice and duplicity, nor that encourage immorality, by protecting the participants from the consequences of their choices.
